What looks like a grammatical question is in reality a question of life in freedom or in captivity. As long as animals are treated as things in court it is extremely difficult to have the law support animal welfare. It remains more or less good will of the human being who owns an animal if he or she wants this animal to live a pleasant or horrific life.
There is a way out of this conundrum, though. Lawyers in several countries have started to think of ways how to change the law in favor of non-human beings. In the US, a lawsuit is being presented in the name of a chimpanzee.
Once the legal status of animals will habe been changed chances will become unequivocally better to end their misery in many prison-lie situations.
